Typographical and Photographic Errors
In the event that a Vent Racing Technologies, LLC. product is mistakenly listed at an incorrect price, Vent Racing Technologies, LLC. reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Vent Racing Technologies, LLC. reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Vent Racing Technologies, LLC. shall issue a credit to your credit card account in the amount of the incorrect price.As our products are frequently changed and updated to better serve their function, pictures on the site might vary slightly from the actual product. Some products are also displayed as part of a completed vehicle. These products do not include any items that may be included in the photograph. Photographs are used for reference purposes only.
Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Vent Racing Technologies, LLC. without notice at any time, for any reason. Your use of this site shall be governed in all respects by the laws of the state of Utah, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Vent Racing Technologies, LLC. products) shall be in the state or federal courts located in Davis County, Utah. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Vent Racing Technologies, LLC. products) must be commenced within one (1) year after the claim or cause of action arises. Vent Racing Technologies, LLC.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Vent Racing Technologies, LLC. may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site
Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Vent Racing Technologies, LLC. or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. CAGE WARRANTY
Limited Warranty VENT RACING TECHNOLOGIES, LLC. provides a 30-Day Return Window (see Return of Non-Defective Products below) and the following limited warranty. This limited warranty extends only to the original purchaser. Please note that any warranty services or questions must be accompanied by the invoice number from the transaction through which the warranted product was purchased. The order number serves as your warranty number and must be retained. VENT RACING TECHNOLOGIES, LLC will offer no warranty service without this number. VENT RACING TECHNOLOGIES, LLC, in the event that the original purchaser, with the original invoice number, damage one of our cages in the course of normal driving, will warrants any, unmodified, non-customized, cage with standard options for 12 months after original invoice date. (Custom cages or cages that the customer has requested special modifications (removed gussets, no bumper, modified differential plate, etc.) on will not be covered.) VENT RACING TECHNOLOGIES, LLC will replace the damaged cage with new or reconditioned parts at VENT RACING TECHNOLOGIES, LLC’s option, without charge to you. You must submit photos of the damaged cage, submit a copy of the original invoice, and cut off either the cage clamps or bungs and ship to us as proof of damage. Customers are responsible for shipping costs of proof and shipping of replacement cage. All shipping fees both to and from VENT RACING TECHNOLOGIES, LLC must be paid by the customer. All returns must be affected via the Procedures for Obtaining Warranty Service described below. All original parts (parts installed by VENT RACING TECHNOLOGIES, LLC at the original build) replaced by VENT RACING TECHNOLOGIES, LLC or its authorized service center, become the property of VENT RACING TECHNOLOGIES, LLC. Any after-market additions or modifications will not be warranted. VENT RACING TECHNOLOGIES, LLC makes no other warranty, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or conformity to any representation or description. VENT RACING TECHNOLOGIES, LLC makes no warranty or representation, either express or implied, with respect to any other manufacturer’s product or documentation, its quality, performance, merchantability, fitness for a particular purpose, or conformity to any representation or description. Except as provided below, VENT RACING TECHNOLOGIES, LLC TECHNOLOGIES, LLC is not liable for any loss, cost, expense, inconvenience or damage that may result from use or inability to use our products. Under no circumstances shall VENT RACING TECHNOLOGIES, LLC be liable for any loss, cost, expense, inconvenience or damage exceeding the purchase price. The warranty and remedies set forth below are exclusive and in lieu of all others, oral or written, expressed or implied. No reseller, agent or employee is authorized to make any modification, extension or addition to this warranty. Warranty Conditions The above Limited Warranty is subject to the following conditions: 1. This warranty extends only to products distributed and/or sold by VENT RACING TECHNOLOGIES, LLC. It is effective only if the products are purchased and operated in the USA. (Within the USA including US 48 States, Alaska and Hawaii.) 2. This warranty covers only normal use. VENT RACING TECHNOLOGIES, LLC shall not be liable under this warranty if any damage or defect results from (i) misuse, racing, abuse, neglect, improper shipping or installation; (ii) disasters such as fire, flood, lightning or improper electric current; or (iii) service or alteration by anyone other than an authorized VENT RACING TECHNOLOGIES, LLC representative; (iv) damages incurred through irresponsible use. 3. You must retain your bill of sale or other proof of purchase to receive warranty service. 4. No warranty extension will be granted for any replacement part(s) furnished to the purchaser in fulfillment of this warranty. 5. VENT RACING TECHNOLOGIES, LLC and its Authorized Service Center accepts no responsibility for any personal items or parts left in products returned for repair to VENT RACING TECHNOLOGIES, LLC. 6. All non-VENT RACING TECHNOLOGIES, LLC manufactured items are licensed to customers under non-VENT RACING TECHNOLOGIES, LLC vendor’s term and conditions. 7. This warranty does not cover any third party products or related problems. 8. VENT RACING TECHNOLOGIES, LLC makes no warranty either expressed or implied regarding third-party (non-VENT RACING TECHNOLOGIES, LLC) products. 9. Thirty-day Return Window does not include special order merchandise and shipping and handling fees. Return of Non-Defective Products A non-defective product may be returned to VENT RACING TECHNOLOGIES, LLC within thirty (30) days of the invoice date for a refund of the original purchase price with the following amendments/fees: 1. VENT RACING TECHNOLOGIES, LLC will refund neither the original shipping cost nor the shipping and handling fees incurred from the products return. If the original purchase was made under a “Free Shipping” promotion then a standard $20 fee will be deducted from any return in counter to that offer. 2. No refund will be granted for products which has been opened, used, or tampered with in any way which jeopardized VENT RACING TECHNOLOGIES, LLC’s ability to remarket or resell the product. VENT RACING TECHNOLOGIES, LLC maintains full discretion in decisions regarding a products fitness for return. 3. Any non-defective returns are subject to a 15% restocking fee, which percentage is taken from the final purchase price less any shipping or handling charges. 4. Quantity purchases for resale of three cages or more are not eligible for return. To return a defective product, please contact our Customer Service Department for a Return Merchandise Authorization (RMA) number and follow the Return of Products Instructions below. The RMA is valid for 10 days from date of issuance. Returns will not be accepted without an RMA. Manufacturer restrictions do apply. Procedures for Obtaining a Cage Replacement. RMA (Returning Merchandise Authorization) Policy: If a return is required, the customer must obtain a RMA number, submit several photographs of the damaged cage and machine, cut off and return either the cage clamps or the bungs, and provide proof of purchase. RMA and services are rendered by VENT RACING TECHNOLOGIES, LLC only. Any shipping costs after 30 days (starting from the original date of purchase) on any item returned for repair is the customers’ responsibility. All returned parts must have a RMA number written clearly on the outside of the package along with a letter detailing the problems and a copy of the original proof of purchase. No COD packages will be accepted. No package will be accepted without a RMA number written on the outside of the package. RMA numbers are only valid for 30 days from the date of issue. Should you have any problems with your computer, please follow these procedures to obtain the service: 1. Pack the parts in its original box or a well-protected box, as outlined in the Return Shipping Instructions. VENT RACING TECHNOLOGIES, LLC will not be responsible for shipping damage/loss of any product. It is very important that you write the RMA number clearly on the outside of the package. Ship the item with a copy of your bill of sale or other proof of purchase, your name, address, phone number, description of the problem(s), and the RMA number you have obtained to: VENT RACING TECHNOLOGIES, LLC RMA#____________ FREEPORT WEST INDUSTRIAL F7 SECTION 3A CLEARFIELD, UT 84016 2. Upon receiving the item(s), VENT RACING TECHNOLOGIES, LLC will repair or replace your item(s) (at VENT RACING TECHNOLOGIES, LLC’s discretion) and will ship it back to you within 2 weeks (dependent on parts availability) via UPS. Refunds will be processed within five (5) business days. 3. Cross-exchange will not be allowed under any circumstances. 4. VENT RACING TECHNOLOGIES, LLC will not pay for shipping to or from the customer. All shipping fees both for under warranty and post warranty repairs are the sole responsibility of the customer. The customer also assumes full liability for losses or damages resulting from shipping as well as all responsibility to pursue remuneration for such issues with their selected carrier. Customer Service: · sales@ventracing.com WARRANTY EXCLUSIONS VENT RACING TECHNOLOGIES, LLC does not offer technical support for any 3rd party products including installation or tuning of engine components. Technical support and tuning should be pursued through a qualified mechanic in your local area. VENT RACING TECHNOLOGIES, LLC accepts no liability for problems caused by after-market products or modifications or additions. VENT RACING TECHNOLOGIES, LLC is not responsible for giving any technical support concerning the installation or tuning of any component the customer did not pay VENT RACING TECHNOLOGIES, LLC to install. VENT RACING TECHNOLOGIES, LLC is not responsible for loss of time, even with hardware failure. VENT RACING TECHNOLOGIES, LLC is not responsible for any loss of work (“down time”) caused by a product requiring service. This warranty is null and void if the defect or malfunction was due to damage resulting from operation not within manufacturer specifications. It will also be null and void if there are indications of misuse and/or abuse. VENT RACING TECHNOLOGIES, LLC has the option of voiding the warranty if anyone other than a VENT RACING TECHNOLOGIES, LLC technician attempts to service the product. VENT RACING TECHNOLOGIES, LLC will not warrant any problems arising from an act of God (lighting, flooding, tornado, etc.), or problems arising out of additional hardware, or additional items added to complement any system/component bought at VENT RACING TECHNOLOGIES, LLC. Under no circumstances will VENT RACING TECHNOLOGIES, LLC be responsible for any refund or remuneration exceeding the original purchase price of the product less any shipping fees. VENT RACING TECHNOLOGIES, LLC will not be held responsible for typographical errors on sales receipts, repair tickets, or on our website. VENT RACING TECHNOLOGIES, LLC makes every effort to make sure all information on our website is correct.
